Terms of service
These terms apply when you buy from kotavya.com. Please read them before placing an order. They don't affect your statutory rights as a consumer.
1. About us
Kotavya is a trading name of Kota Trading Ltd, a private limited company registered in England and Wales under company number 17388505. Registered office: 66 Paul Street, London, EC2A 4NA, United Kingdom. Email: info@kotavya.com.
2. What we sell
We design artwork and print it to order onto quality blank products (such as t-shirts, hoodies, mugs, prints and bags) made by established third-party manufacturers. The blank garment or product may carry its maker's own label. We show colours as accurately as we can, but screens vary, so your item may look slightly different from what you see. Because each item is printed individually, small variations in print position (up to about 2 cm) are normal and are not a fault.
3. Prices and payment
Prices are in pounds sterling and include VAT where it applies. Delivery charges are shown at checkout before you pay. We take payment when you place your order. If we've made an obvious pricing error, we'll contact you before your order is printed and you can cancel for a full refund.
4. Your order and our contract
After you order, we'll email to confirm we've received it. Our contract with you starts when we send that confirmation. We may decline an order, for example if an item is unavailable or we suspect fraud. If so, we'll let you know and refund you in full.
5. Delivery
Production and delivery times are set out in our Shipping Policy. The item becomes your responsibility once it's delivered to the address you gave us.
6. Returns, cancellations and faulty items
Your rights are explained in our Returns & Refunds policy. In short: personalised items can't be returned for a change of mind; standard designs can be cancelled within 14 days (you pay return postage); and damaged, faulty or misprinted items are always put right at our cost.
7. Personalised orders
If you send us text or images for a personalised item, you confirm you have the right to use them and that they're not offensive or unlawful. We may refuse to print anything we consider inappropriate. Please check your spelling carefully, as we print exactly what you provide.
8. Our designs
All Kotavya designs, photos and text on this site belong to Kota Trading Ltd or are used under licence. You may not copy, reproduce or sell them without our written permission.
9. Our responsibility to you
If we break these terms, we're responsible for loss or damage you suffer that's a foreseeable result of our breach. We don't exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breach of your legal rights in relation to the products. We sell products for domestic and private use only and aren't responsible for business losses.
10. Events outside our control
We aren't responsible for delays caused by events outside our reasonable control, such as courier disruption or severe weather. If a delay looks likely, we'll tell you and you may cancel for a full refund.
11. Changes to these terms
We may update these terms from time to time. The version in force when you placed your order applies to that order.
12. Law and disputes
These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in the courts where you live. If you have a complaint, please get in touch first and we'll do our best to put it right.
